本利用規約(以下「本規約」)は、Ryoichi Shimamura(個人開発者、日本。以下「開発者」)が提供するiOSアプリ「おもいでメロディ」(以下「本アプリ」)の利用条件を定めるものです。本アプリをご利用いただくことで、本規約に同意したものとみなされます。

本規約は、Appleの標準EULA(Licensed Application End User License Agreement)を補完するものです。本規約に定めのない事項は、同EULAが適用されます。

1. サービスの内容

本アプリは、鼻歌から思い出の曲を特定し、30秒プレビューの再生、AI生成の「思い出カード」、ご家族による反応記録の機能を提供する、認知症のご家族のための音楽ケアアプリです。

2. 医療に関する重要な注意

本アプリは医療機器ではなく、認知症その他の疾患の診断・治療・予防を目的とするものではありません。本アプリが提供する情報や機能は、医療上の助言に代わるものではありません。健康状態や治療に関する判断は、必ず医師などの専門家にご相談ください。

3. サブスクリプション

• 本アプリの有料機能は月額のサブスクリプションで提供され、7日間の無料トライアルがあります。
• 料金はお客様のApple IDアカウントに課金されます。
• サブスクリプションは、期間終了の24時間前までに解約しない限り自動更新されます。
• 解約・管理は、App Store(Apple ID)の設定画面から行えます。アプリを削除しても解約にはなりません。
• 無料トライアル中に解約した場合、料金は発生しません。

4. 楽曲・コンテンツの権利

• 30秒プレビューは、Appleが提供する試聴音源を利用しています。楽曲の権利は各権利者に帰属します。
• YouTubeへのリンクは外部サービスへの案内であり、そのコンテンツについて開発者は責任を負いません。
• AI生成の「思い出カード」の内容は参考情報であり、正確性を保証するものではありません。

5. 禁止事項

本アプリの複製・改変・リバースエンジニアリング、法令に違反する利用、第三者の権利を侵害する利用を禁止します。

6. 免責事項

開発者は、本アプリの正確性・完全性・特定目的への適合性を保証しません。本アプリの利用または利用不能により生じた損害について、開発者の故意または重過失による場合を除き、責任を負いません。曲の特定結果やAI生成内容が正確でない場合があることをあらかじめご了承ください。

7. 規約の変更

開発者は、必要に応じて本規約を変更することがあります。重要な変更は、アプリ内またはApp Storeのページでお知らせします。変更後に本アプリを利用された場合、変更後の規約に同意したものとみなします。

8. 準拠法・管轄

本規約は日本法に準拠し、本アプリに関する紛争は、日本の裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service ("Terms") govern your use of Memory Melody ("the App"), an iOS application provided by Ryoichi Shimamura, an individual developer based in Japan ("the Developer"). By using the App, you agree to these Terms.

These Terms supplement Apple's standard Licensed Application End User License Agreement (EULA). Matters not covered here are governed by that EULA.

1. The Service

The App is a music care app for families of people living with dementia. It identifies remembered songs from humming, plays 30-second previews, generates AI "Memory Cards" (era topics and conversation starters), and lets family members log reactions.

2. Important Medical Notice

The App is not a medical device and is not intended to diagnose, treat, or prevent dementia or any other condition. Nothing in the App is a substitute for professional medical advice. Always consult a physician or other qualified professional for decisions about health or treatment.

3. Subscriptions

• Paid features are offered as a monthly subscription with a 7-day free trial.
• Payment is charged to your Apple ID account.
• The subscription renews automatically unless canceled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your App Store (Apple ID) settings. Deleting the App does not cancel a subscription.
• No charge applies if you cancel during the free trial.

4. Music and Content Rights

• 30-second previews are audition audio provided by Apple. All rights to the music belong to their respective owners.
• YouTube links point to an external service; the Developer is not responsible for its content.
• AI-generated Memory Card content is provided for reference and its accuracy is not guaranteed.

5. Prohibited Conduct

You may not copy, modify, or reverse-engineer the App, use it in violation of applicable law, or use it in a way that infringes the rights of others.

6. Disclaimer of Warranties and Liability

The App is provided "as is." The Developer does not warrant its accuracy, completeness, or fitness for a particular purpose. Except in cases of willful misconduct or gross negligence, the Developer is not liable for damages arising from use of, or inability to use, the App. Song identification results and AI-generated content may be inaccurate.

7. Changes to These Terms

The Developer may update these Terms as needed. Material changes will be announced in the App or on its App Store page. Continued use of the App after a change constitutes acceptance of the updated Terms.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute relating to the App shall be subject to the exclusive jurisdiction of the courts of Japan in the first instance.
